Security Deposit Refunds After a JBSA PCS: The 30-Day Rule and the Forwarding Address Trap

Texas gives you a strong statutory right to your deposit back — but PCSing out of San Antonio breaks the rule for most servicemembers because of one missed step. Here is how to get the money.

Texas Property Code § 92.103 requires your San Antonio landlord to refund your security deposit within 30 days — but only after you surrender the property and give them a written forwarding address. PCS orders break that second half for most servicemembers, because by the time the deposit should land, you are already in Okinawa, Ramstein, or Minot with a new APO and nobody at the Bexar County property management office knows where to send a check. The fix is procedural, not legal, and if you set it up before you clear housing you almost never have to fight.

This is the piece of the move that gets handled last and lost first. Below is how it actually works at JBSA-Lackland, Randolph, and Fort Sam Houston, and what to do when a landlord stalls.

What the 30-day rule actually says

Under § 92.103, the landlord has 30 days from the date you surrender possession to refund the deposit or send an itemized list of deductions. Two conditions trigger that clock:

  • You have surrendered the property (keys returned, lease ended, possession given up).
  • The landlord has your forwarding address in writing.

Miss the forwarding address and the 30-day clock does not start. The landlord is not legally obligated to hunt you down. This is the single most common reason PCS families from JBSA never see their deposit — not fraud, not fake damage claims, just a check sitting in a file because 3421 Rigsby Ave is no longer where you live and nobody wrote down the new address.

Put the forwarding address in writing, with a date

Email works. Certified mail works better. A line in your move-out walkthrough form works if the landlord signs it. What does not work: telling the leasing agent verbally on your way out the door. If you do not yet have your gaining-base address, use a trusted family member's address, your sponsor's address at the new base, or an MPO/APO once it is active. Update it in writing as soon as you have the permanent one.

Why PCS move-outs are different

A normal Texas tenant moves across town, picks up mail, and knows within a week if something is wrong. A PCS tenant is often:

  • Flying out before the final walkthrough.
  • Using a POA so a spouse or sponsor can hand over keys.
  • Receiving mail at three addresses in 60 days (old SA address, TLF at gaining base, permanent quarters).
  • Dealing with a property manager who knows the deposit check will never be chased hard.

All of that increases the odds of a slow or incomplete refund. None of it changes your rights under Chapter 92.

What a landlord can legally deduct

Texas Property Code § 92.104 lets a landlord deduct for damages beyond normal wear and tear and for amounts you owe under the lease. It does not let them deduct for normal wear and tear — faded paint, minor carpet wear, nail holes from pictures, worn weatherstripping. If the itemized list includes those, push back.

Common lawful deductions at a Bexar County rental:

  • Unpaid rent or utilities you were responsible for (CPS Energy, SAWS).
  • Cleaning beyond ordinary move-out condition — document with photos.
  • Carpet replacement when there is actual damage (pet urine, burns), prorated for age.
  • Repair of holes larger than standard picture hangers, broken blinds, damaged appliances.
  • Lease-break fees only if the lease has a liquidated damages clause and SCRA § 3955 does not apply. If you terminated under the Military Clause with 30 days' notice after the next rent date, no early-termination fee is owed.

If the deductions total less than the deposit, the balance plus the itemized list must come back within 30 days.

The bad-faith penalty most tenants never claim

Section 92.109 is the leverage. If a landlord retains the deposit or fails to provide the itemized list in bad faith, the tenant may recover $100 plus three times the wrongfully withheld amount plus reasonable attorney's fees. Bad faith is presumed if the landlord fails to return the deposit or provide the written description and itemization on or before the 30th day.

That presumption is powerful. In a JP court, you are not proving the landlord acted maliciously — you are showing you surrendered the unit, gave written forwarding address on a specific date, and no refund or itemization arrived within 30 days. The burden shifts.

Suing in a Bexar County JP court

If a demand letter does not produce the check, the right venue is the Justice of the Peace court for the precinct where the rental sits. Bexar County has four JP precincts, and filing is done through eFileTexas. Small claims cap is $20,000, well above any residential deposit dispute.

Before you file

  • Send a written demand by certified mail, return receipt. Reference § 92.103, § 92.104, and § 92.109. Give a deadline — 10 business days is reasonable.
  • Attach your move-out photos, the signed walkthrough, the lease, and proof of your written forwarding address.
  • Keep the SCRA notice and PCS orders in the same packet if you terminated early.

Most property managers settle at the demand-letter stage once § 92.109 is on the page. The treble-damages exposure on a $2,000 deposit is $6,100 plus fees — not a fight a professional landlord wants.

Documenting a move-out you can't attend in person

If you are already at the gaining base, protect yourself:

  • Take dated, time-stamped video of every room, closet, appliance, and the exterior on the day you leave. Walk slowly. Open cabinets.
  • Keep the signed move-in condition form from day one. Compare side by side.
  • Give a trusted person a limited POA to attend the walkthrough and sign the move-out form. A fellow servicemember or your sponsor works.
  • Request a copy of the walkthrough form, signed by the landlord's representative, before keys are handed over.

Video trumps almost every "we found damage" claim because it establishes the condition the day you left.

What most people get wrong

  • Treating the forwarding address as optional. It is the key that starts the clock. No written address, no 30-day obligation. Send it certified before you fly out.
  • Assuming the Military Clause waives the deposit. SCRA § 3955 terminates the lease without penalty — it does not forfeit your deposit or excuse normal move-out obligations. You still clean, you still walk through, you still owe for actual damage.
  • Letting the property manager verbally promise a refund timeline. Texas gives you 30 days by statute. A property manager saying "we usually take 60" is telling you they plan to violate § 92.103. Correct it in writing.
  • Paying a last month's rent out of the deposit. Section 92.108 bars the tenant from applying the deposit to the last month's rent, and doing so forfeits the § 92.109 bad-faith remedy. Pay the last month, then demand the deposit back.
  • Filing in the wrong JP precinct. The venue is the precinct where the rental is located, not where you live now. Confirm precinct on the Bexar County JP court map before e-filing.
  • Waiting past the statute of limitations. You have four years to sue for a wrongfully withheld deposit under Texas law, but memories and property management turnover kill cases long before then. File within six months of the 30-day deadline passing.

Setting up the next lease the right way

If you are reading this because you are PCSing into San Antonio and want to avoid the same trap on the back end, build the forwarding-address habit now: keep a copy of the move-in walkthrough, insist on itemized deposit terms in the lease, and know which JP precinct your rental sits in before you sign.
